Decision of the Council of State regarding the request to maintain a claim in a CSPE dispute
In a dispute concerning the CSPE, the Council of State ruled that the mere appointment of an attorney to represent the company before the court does not constitute a response to the court’s request for confirmation that the petition is being maintained.
It also states that the request to uphold the findings "due to the Energy Regulatory Commission's establishment of a transaction platform, accessible since February 2021, as part of the program for the partial reimbursement of the public service contribution for electricity" is well-founded.
The Court therefore rightly concluded that the Company’s failure to expressly confirm that it was maintaining its claim led to its withdrawal.
